Terms and Conditions

§ 1 Scope and provider

These terms apply to the use of the Basilo app. The provider is Rami Rouatbi, Periplus, Albanstr. 11, 12277 Berlin, Germany ("we"). Different terms of users do not apply.

The licence to use the app is also governed by Apple's Licensed Application End User License Agreement (standard EULA).

§ 2 Services

  1. From what you enter, Basilo creates a weekly dinner plan, a shopping list and recipes with nutritional values.
  2. The prices shown are average prices we collected in supermarkets. Actual prices, pack sizes and availability may differ by shop, region and time. We do not guarantee that your shopping stays within the budget you chose.
  3. Nutritional values are calculated from average values of the ingredients and are approximate.
  4. We keep developing Basilo and may change features, as long as the core of the service remains and the change is reasonable for you.

§ 3 Account

  1. To use Basilo you need an account, created with Apple or Google. You must be at least 16 years old.
  2. The account is personal. Basilo may only be used for private, non-commercial purposes. Automated extraction of content is not allowed.

§ 4 Subscription

  1. Using Basilo requires a subscription ("Basilo Premium"), monthly or yearly. You see the current prices in the app before buying.
  2. You buy the subscription through Apple's App Store. Purchase, payment, renewal and cancellation are governed by Apple's terms (Apple Media Services); for these, Apple is your contractual partner.
  3. The subscription renews automatically for the chosen period unless you cancel it at least 24 hours before the end of the period. You can cancel at any time in your Apple ID settings (also via "Manage subscription" in the app).
  4. If the app offers a free trial, the subscription becomes paid when the trial ends, unless you cancel at least 24 hours before.
  5. Apple's rules apply to refunds and the right of withdrawal for App Store purchases (reportaproblem.apple.com).
  6. Offer codes are redeemed through the App Store; the conditions shown there apply.

§ 5 Allergies, diet and health

  1. Basilo leaves out recipes according to your allergies, diet and dislikes. Allergen information is based on typical products and may differ by brand.
  2. Always check the ingredient list on the package, especially with allergies and intolerances.
  3. Basilo is not medical or dietary advice and does not replace it.

§ 6 Availability

We aim for the app to work without interruption. Maintenance, outages at service providers or a missing internet connection may limit its use at times. Many features also work offline.

§ 7 Liability

  1. We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act.
  2. For slight negligence we are only liable for breach of an essential contractual obligation, whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely; liability is then limited to the typical, foreseeable damage.
  3. Otherwise, liability is excluded.

§ 8 Deleting your account

You can delete your account at any time in the app (Account → Delete account). Your data is then deleted (see the Privacy Policy). A running Apple subscription is not cancelled by this; cancel it first in your Apple ID settings.

§ 9 Changes to these terms

We may change these terms when the app, the law or case law changes. We inform you of changes in good time in the app. Changes to essential rights and obligations (in particular the scope of the service and the price) only apply with your consent.

§ 10 Final provisions

  1. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory consumer protection rules of your country of residence remain unaffected.
  2. The contract language is German. The English version of these terms is for information only.
  3. If a provision is invalid, the remaining provisions remain valid.
